CREW and GWU Law Professor File Third Amicus Brief Detailing Ways DOMA Undermines Laws

Gavel and Scale of JusticeToday, Citizens for Responsibility and Ethics in Washington (CREW) and George Washington University Law School Professor Alan Morrison filed an amicus (friend-of-the-court) brief in the U.S. Court of Appeals for the Second Circuit in Windsor v. Bipartisan Legal Advisory Group, a lawsuit challenging the constitutionality of the Defense of Marriage Act (DOMA).  CREW has filed similar briefs in the Ninth and First Circuits, identifying the myriad ways in which DOMA’s exclusion of same-sex married couples from the definition of marriage undermine various ethics reporting laws, as well as provisions of the Tax and Bankruptcy Codes.  The Second Circuit cited CREW’s ethics arguments as an additional basis for its conclusion DOMA is unconstitutional.
